PLEASE READ THESE TERMS OF SERVICE CAREFULLY BEFORE USING THIS WEBSITE. BY ACCESSING OR USING WWW.SHOWHOMES.COM (THE “SITE”), YOU AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE, DO NOT USE THE SITE.

These Terms of Service (“Terms”) govern your access to and use of the Site operated by Showhomes Franchise Company, LLC and its affiliated entities (“Showhomes,” “we,” “our,” or “us”). These Terms apply to all visitors, prospective customers, real estate professionals, and franchise inquirers who access the Site.

1. Acceptance of Terms

By using this Site, you represent that you are at least 18 years of age (or the age of majority in your jurisdiction), that you have the legal authority to enter into these Terms, and that you agree to comply with all applicable laws and regulations. Your continued use of the Site following any modification to these Terms constitutes your acceptance of the revised Terms.

2. Description of Services

Showhomes is a national home staging franchise network. The Site is an informational and lead-generation platform that allows users to:

  • Learn about Showhomes home staging and property management services
  • Submit inquiries to connect with a Showhomes franchise location in their area
  • Request consultations or estimates for home staging services
  • Explore franchise ownership opportunities
  • Access educational content related to home staging and real estate

The Site does not itself provide home staging services. All services are delivered by independently owned and operated Showhomes franchise locations. Showhomes Franchise Company, LLC acts as the franchisor and does not directly manage or guarantee the performance of individual franchise locations.

3. Franchise Location Disclaimer

Each Showhomes franchise is an independently owned and operated business. When you submit a service inquiry through the Site, your information may be referred to one or more franchise locations. Showhomes Franchise Company, LLC does not control the day-to-day operations of franchise locations and is not responsible for the acts, omissions, representations, or service quality of individual franchisees.

Any agreement for home staging or related services will be entered into directly between you and the applicable franchise location. Showhomes Franchise Company, LLC is not a party to those service agreements.

4. Intellectual Property

4.1 Ownership

All content on the Site, including but not limited to text, photographs, graphics, logos, video, audio, and software (collectively, “Content”), is the property of Showhomes Franchise Company, LLC or its licensors and is protected by United States and international copyright, trademark, and other intellectual property laws.

4.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Site for personal, non-commercial purposes in accordance with these Terms. You may not reproduce, distribute, modify, create derivative works from, publicly display, or exploit any Content without our prior written consent.

4.3 Trademarks

“Showhomes” and associated logos and service marks are registered or common law trademarks of Showhomes Franchise Company, LLC. Nothing on the Site grants you any right to use our trademarks without prior written permission.

5. User Conduct

When using the Site, you agree not to:

  • Use the Site for any unlawful purpose or in violation of any applicable regulations
  • Submit false, misleading, or fraudulent information in any inquiry or contact form
  • Attempt to gain unauthorized access to any portion of the Site, its systems, or related networks
  • Transmit any viruses, malware, or other harmful code
  • Scrape, crawl, or use automated tools to collect data from the Site without our written consent
  • Impersonate Showhomes, any franchise location, or any individual
  • Interfere with or disrupt the operation of the Site or its servers
  • Use the Site to send unsolicited commercial communications (spam)

We reserve the right to terminate or restrict your access to the Site at any time for any reason, including violation of these Terms, without notice or liability.

6. Submissions and Communications

By submitting any inquiry, message, feedback, or other information through the Site, you grant Showhomes a non-exclusive, royalty-free, perpetual license to use such submissions for the purpose of responding to your request, improving our services, and internal business operations. You represent that your submissions are accurate and that you have the authority to provide the information submitted.

Submitting an inquiry does not create a contractual obligation on the part of Showhomes or any franchise location. Service arrangements require a separate written agreement with the applicable franchise.

7. Third-Party Links and Services

The Site may contain links to third-party websites, social media platforms, or services not operated by Showhomes. These links are provided for convenience only. We do not endorse, control, or take responsibility for the content, privacy practices, or terms of any third-party sites. Your use of third-party sites is at your own risk and subject to those sites’ terms and policies.

8. Disclaimer of Warranties

THE SITE AND ALL CONTENT ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant the accuracy, completeness, or timeliness of any Content. Service availability, pricing, and franchise locations referenced on the Site are subject to change without notice.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, SHOWHOMES FRANCHISE GROUP, LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, FRANCHISE LOCATIONS, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL — ARISING FROM OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM YOUR USE OF THE SITE EXCEED ONE HUNDRED DOLLARS ($100.00).

Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the above limitations may not apply to you.

10. Indemnification

You agree to defend, indemnify, and hold harmless Showhomes Franchise Company, LLC and its affiliates, franchisees, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of the Site; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) any information you submit through the Site.

11. Privacy

Your use of the Site is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Site, you consent to the collection, use, and disclosure of your information as described in our Privacy Policy available at www.showhomes.com/privacy-policy.

12. SMS / Text Messaging

By providing your mobile phone number and opting in through any of the following methods, you agree to receive recurring automated SMS and MMS text messages from Showhomes Franchise Company, LLC and/or the Showhomes franchise location serving your area:

  • Web form: Checking the SMS consent checkbox on any Showhomes website form or landing page
  • Text opt-in: Texting a designated keyword (such as START or JOIN) to a Showhomes short code or long code number
  • Verbal/offline consent: Providing oral or written consent to a Showhomes representative or franchisee, which will be documented in our records

These messages may include appointment reminders, service-related updates, and promotional or marketing communications.

Your consent to receive SMS messages is not required as a condition of receiving any service or making any purchase from Showhomes.

12.2 Message Frequency and Rates

Message frequency will vary. Message and data rates may apply based on your mobile carrier and plan. Showhomes is not responsible for any fees or charges assessed by your wireless provider.

12.3 Opt-Out

You may opt out of SMS communications at any time by replying STOP to any message received from us. Upon opting out, you will receive a single confirmation message and no further SMS messages will be sent unless you re-subscribe. To opt back in, reply START or re-submit your consent through our website.

Opting out of SMS does not affect other communications you may receive from us, such as email. To opt out of all communications, contact us at privacy@showhomes.com.

12.4 Help and Supported Carriers

For help, reply HELP to any SMS message or contact us at privacy@showhomes.com. Showhomes is not liable for delayed or undelivered messages. Supported carriers include major U.S. carriers such as AT&T, T-Mobile, Verizon, Boost Mobile, and U.S. Cellular, among others.

12.5 TCPA Compliance

Our SMS program is operated in compliance with the Telephone Consumer Protection Act (TCPA) and applicable FCC regulations. By opting in, you represent that you are the account holder or authorized user of the mobile number provided, and that you are authorized to consent to receive SMS messages at that number.

13. Governing Law and Dispute Resolution

13.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law principles. You consent to personal jurisdiction in the state and federal courts located in Miami-Dade County, Florida for any disputes arising under these Terms.

13.2 Informal Resolution

Before initiating any formal legal proceedings, you agree to first contact us at legal@showhomes.com and provide a written description of the dispute. The parties will attempt in good faith to resolve the dispute within thirty (30) days of notification.

13.3 Class Action Waiver

To the fullest extent permitted by law, you waive any right to bring claims against Showhomes as a class, collective, or representative action. All disputes must be brought in your individual capacity only.

14. Modifications to the Site and Terms

We reserve the right to modify, suspend, or discontinue the Site or any feature at any time without notice or liability. We may also update these Terms at any time. The most current version will always be posted on the Site. Your continued use of the Site after any changes constitutes your acceptance of the updated Terms.

15. Severability and Entire Agreement

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the remaining Terms remain in full force and effect. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Showhomes regarding your use of the Site and supersede any prior agreements or understandings.
